8/16/26 meeting minutes read and approved

(steward ) member review for Aaron and Mikayla Palmer for: “maintaining an uninhabitable living environment that has negatively impacted several neighboring units members' health.”

Serenity: we can start with going over how the member review process works?

Kate: first the reasons for review are read, then the individuals being reviewed are given a chance to respond. next folks can ask clarifying questions, and then when folks feel ready to decide on an option, we ask the members being reviewed to step out of the meeting while members discuss whether they want to vote for a termination of membership (eviction), a behavior contract, or no action. a strawpoll is held to decide between the three outcomes, and in the event eviction is voted for, paper ballots are distributed to vote to evict (75% must vote yes to pass).

Serenity: the member review reads: “member review for Aaron and Mikayla Palmer for maintaining an uninhabitable living environment that has negatively impacted several neighboring units members' health”. the floor is y'alls

Mikayla: we feel that house policy regarding communication and conflict resolution was not followed, and ask the house to consider options other than eviction as we do not have anywhere else to go. if the house does vote for eviction we will follow legal options to defend ourselves.

Bernard: notice was given, you spoke with our operations manager.

Mikayla: it was only two days before we got an inspection notice.

Corey: there have been documented reports of people in all three units adjacent to yours suffering ill health effects due to a chemical smell coming from your unit.

David: i also wanted to re-introduce myself and clarify that if you all would like to appeal the member review decision you can do so with the board.

Reyna: what sort of chemicals are yall using?

Mikayla: Aaron has a large 3D printers that need an acetone bath, and i do art with various found materials that could be causing the smell. we have ventilation but can add more

Jill: i wasnt aware this was happening.

Mikayla: so you didnt report a smell?

Diana: Nick did though.

Kate: i wanted to ask danzale, what did the smell smell like?

Danzale: it smelled like roach spray.

Bernard: to me it did not smell like that and to my research it was something else so i reached out to Corey.

Mikayla: i just wish you all had reached out to us directly, we would have been happy to purchase more filtration.

Corey: one, it does not matter what the source of the smell is at this point, and two, you knew about the inspection but did not bother to disclose until now that you are doing industrial 3D printing.

Mikayla: when we were approached we told the issue was smoking so we did not think to bring it up.

Aaron: we are happy to comply with whatever yall ask, we just do not want to lose our home.

Kate: i wanted to ask the folks who did the inspection what they smelled.

Ivy: i can't speak to what the smell was like in the adjoining units, but when i did the inspection there was a persistent acidic smell with a lot of different kinds of scented cleaners on top of that; it made me dizzy during the inspection but i did not feel it was something to bring up until after i left and confirmed i was smelling something off.

Serenity: i went in and looked around and while i didnt see anything visually amiss, i also didnt see anything that looked like a 3D Printer.

Mikayla: its a smaller, portable model; i clean a lot due to OCD and may have a tendency to overuse cleaning products.

Jamie: if nobody has anything else, we can move on to discussing options.

Aaron and Mikayla leave the meeting.

Serenity: I don't know how else to put it; i know what 3D printing chemicals smell.like, and it does not smell both acrid and sweet. i dont care what the chemical was, i dont like that its causing an issue.

Corey: this is something that is not evidenciary but; I have done my fair share of stinky crafts in my unit and have never had issues with a smell. they would have needed to be 3d printing constantly for several weeks for it to spread to adjacent units.

Serenity: it would have needed to be enough to permeate the subfloor and multiple walls.

Bernard: i dont care what they try to say it is, or that they are trying to make it seem like they were being singled out. we have done many projects and have never had issues with that.

Lorenzo: they knew they were being inconsiderate, and agree with Bernard.

David: point of information, there is a layer of concrete between the top and bottom floor units so it is unlikely that a smell would permeate as much as it has unless it were a lot.

Ivy: our maintenance coordinator did try to handle this, he had hesitated to act intially when he noticed the smell in his unit due to a conflict of interest between himself and aaron and mikayla that i will not disclose as it is not relevant to the reasons for the review, and it was not until bernard and another adjacent unit also reported a smell that he came to myself and David for help navigating a resolution of this issue. when they were notified of the inspection following David's talk with them, they specifically requested that Toast not be involved at all in the handling of the inspection.

Corey: to be clear: toast was smelling it for a while before other ppl reported it and then he was pushed to act.

Bernard: regardless of what the smell is, it is not fair to people to continually choose to do things that are negatively affecting other people and then try to cover it up. my issue is that you must have been doing something to permeate through a concrete floor.

Corey: we are still going to have to do remediation which will be a lot of work, and a lot more expensive than they are likely thinking it will be. compared to previous examples of former members that acted negligently to the point that it was affecting other members, we voted to evict, and doing otherwise would be inconsistent with our previous decisions.

Bernard: i lived next door to Dwayne who used to smoke multiple packs a day and the smell would permeate to my unit, this is nowhere near as bad.

Diana: i do want to say that a few sundays ago when i was cleaning in the commons pantry, i noticed a smell that was persistent and i was unable to clean it up or make it go away, and i did have a headache.

Reyna: Danzale, did the doctors know what caused your breathing issues?

Danzale: no, they did not.

Jamie: do we know exactly how long it was going on?

Bernard: likely several weeks

Diana: when did you go to the hospital?

Danzale: three weeks ago.

Bernard: Nick, did you smell anything?

Nick: yes, sometimes i smell a burning chemical smell.

a strawpoll is held.

14 voted in favor of eviction, 5 voted in favor of a behavior contract.

the vote for eviction passed with an 86% majority (13 yes, 2 no, 1 abstain).

Serenity: we should at least try to give them time to find a place.

Nick: we need to be specific about that.

Reyna: they can ask for an extension.

Corey: a month (30 days) would be the most legally acceptable time, but the shortest we could afford to do is two weeks.

Ivy: we do know they plan on fighting it in court.

Jamie: we should do a more defensible date.

Kate: we can also let them know that from this they will receive a notice to vacate that will not remain on their record unless they do not leave and we have to file an eviction with court.

Bernard: i am comfortable with a week or two.

David: what about what they owe? that may come up in court

Corey: they have been following a verbal payment plan that we approved as a house so it may reflect poorly on us.

Jamie: how long would a board appeal take?

David: We are going to have an emergency board meeting on Thursday and i can reach out to them to ask them if they want to appeal.

Bernard: i think we can start with a week, if they are gonna appeal anyway then they could get a delay.

David: given the considerations yall have, what time feels reasonable to give them enough time without letting them stay here too long.

Bernard: they do not care.

Serenity: I think 2-3 weeks is good

Jamie: agree, 2-3 weeks is good.

Danzale: i think 2 weeks.
